The EUDR (EU Deforestation Regulation) is an EU regulation (2023/1115) that will come into force on 30 December 2025 (with a transitional arrangement for SMEs until 30 June 2026). It prohibits trade in raw materials and products originating from areas subject to deforestation after 31 December 2020. This includes seven key raw materials such as timber, cattle, soya, palm oil, coffee, cocoa and rubber. Violations may be punished with fines of up to 4% of annual turnover. This applies to all companies that import, export or place relevant raw materials on the market within the EU, including both large corporations and SMEs. Whilst large companies are subject to strict reporting obligations, the requirements for SMEs are less stringent. Nevertheless, they must be able to provide the necessary documentation. You must, among other things:
- Establish due diligence and risk management processes: analyse supply chains, identify risks, take action, and produce reports (review annually, retain records for 5 years).
- Prepare a due diligence declaration and, if necessary, submit it online (TRACES).
- Centrally manage data on origin, geographical coordinates, risk analyses and documentation.
The EUDR requires a high degree of transparency, traceability and accessibility, for example with regard to satellite imagery, geodata and automated verification processes.
