The biggest EmpCo question marks in the mid-market segment
Sustainability claims sound convincing — until EmpCo asks: Can you prove them?
Can this statement stay on the website? Is the sales flyer still robust enough? Can we say this in a customer meeting? Is a reference to a certificate enough? Do existing content pieces now need to be revised?
Was viele Teams gerade spüren, ist nicht nur der Druck durch neue Anforderungen – sondern vor allem die Unsicherheit im Tagesgeschäft: Welche unserer Aussagen halten stand? Und welche werden zum Risiko?
This is especially visible with climate claims. But EmpCo affects much more: Sustainability statements of every kind, labels and product attributes. In many companies, sustainability communication has grown over the years — not built systematically, not documented centrally. The work behind it is often solid. But the evidence? Scattered across spreadsheets, PDFs, emails or with individual employees. That is exactly what turns good work into a communication risk.

A lack of data clarity and missing evidence structures become a risk:
-
Sustainability statements and claims are spread across numerous channels
-
Evidence sits in spreadsheets, PDFs or with individual employees
-
What is still safe? What is becoming risky? No one knows for sure.
Without a clear data foundation and a structured system, the effort becomes substantial and the risk even greater — even though EmpCo offers major competitive opportunities for genuine sustainability performance.
From uncertainty around claims to substantiated climate communication
How to meet EmpCo requirements
leadity creates the foundation for EmpCo-compliant communication and helps document and assess sustainability statements on a more robust basis.
This is how substantiated sustainability communication becomes possible under EmpCo:
-
Less gut feeling, more clarity for every claim: Which statement is robust, which is risky, and where is evidence still missing? With cleanly connected data and clear responsibilities, claims can be assessed on a more robust basis and reviewed more transparently.
-
Make targets, progress and reduction pathways demonstrable: Whether it is a reduction pathway, social standards, certification or a sustainability label, EmpCo requires more than good intentions. Targets, measures and reduction pathways must not only sound credible, but also be clearly documented and evidenced.
-
Communicate credibly and stay visible without greenhushing: Robust EmpCo communication helps you classify statements more clearly and communicate them externally with greater confidence. This keeps you visible in the market without slipping into greenhushing out of uncertainty.
Step by step to EmpCo-compliant sustainability communication
How to create the foundation for substantiated sustainability statements
Your path to EmpCo compliance with leadity starts here:
1. Review existing claims and communication channels Get a clear overview: Which statements currently appear on your website, in brochures, sales documents or product communication? Where are terms, labels or sustainability statements being used that are not permissible under EmpCo? This helps you identify early on which statements are robust and where action is needed.
2. Bring data, supporting documents and evidence together in one place Use green claims management software to centralise the relevant data, supporting documents and evidence. This creates a robust foundation for substantiating statements, identifying gaps early and assessing EmpCo-relevant communication with greater confidence.
3. Classify statements clearly and secure them on a robust basis You can now classify statements more clearly: What is specific enough? What can be evidenced? Where is further specification, transparency or additional review needed? This creates confidence for marketing, sustainability and management — for climate claims as well as labels, comparative statements, or statements about social and environmental performance.
4. Keep communication continuously up to date and robust EmpCo is not a one-off project. New data, new targets and new communication needs must be integrated properly on an ongoing basis. With leadity’s EmpCo tool, you create a process that keeps statements, evidence and their underlying basis continuously up to date, traceable and robust.
“A common challenge is the lack of orientation: What exactly needs to be done? How much effort is involved? Especially in light of changing regulations, this creates uncertainty for everyone involved. From my experience, a structured process that sets priorities and brings people across the company along is enormously helpful.”

EmpCo significantly tightens the requirements for voluntary environmental statements. In future, it will no longer be enough for a claim to be well-intentioned or internally plausible. Statements must be specific, traceable, substantiated and, in many cases, clearly specified. Particularly critical are broad terms, unclear climate claims or statements whose evidence is not directly accessible and easy to understand.
EmpCo does not only affect product claims. In principle, it is relevant for all business communication directed externally, including website copy, sales materials, brochures, presentations, press releases and statements made in customer conversations. That is exactly why it is not enough to review only individual phrases. Companies need an overview of where claims are circulating and what they are based on.
Not necessarily. But existing statements should be systematically reviewed and, where needed, specified or adjusted. What matters is whether a claim is defensible, whether the statement is formulated with sufficient precision, and whether the underlying evidence is directly available and clearly traceable.
So the goal is not automatically to remove past statements, but to substantiate them, make them more specific, or adjust them deliberately where necessary.
A defensible statement needs, above all, three things:
- Clear, specific wording
- Data or evidence to support it
- and documentation that makes it fully traceable
Depending on the claim, it may also be important to present targets, progress, or reduction pathways transparently and in a way that can be independently verified. Requirements increase significantly, especially for forward-looking statements or climate-related claims.
leadity helps build the foundation for defensible communication. ESG, climate and ISO data, evidence, certificates and documentation are brought together in a structured way, so statements are not based on scattered individual knowledge. This makes it clearer which statements can be robustly substantiated, where gaps still exist, and which statements should be adjusted. leadity also offers a free EmpCo claims check as a first step, allowing companies to have their existing climate statements reviewed.
No. That would be the wrong conclusion. It’s very clear: silence doesn’t help. Companies should continue to communicate — but more precisely, more defensibly, and more transparently. If you set up sustainability communication properly, you not only reduce risk, you can also show up with more credibility and confidence. So the goal is not greenhushing, but legally sound communication with substance. leadity helps you build exactly the foundation for that.
